An Act to INCORPORATE the VILLAGE of Fort Erie:
in the County of Welland

1857.

Whereas the inhabitants of the Village of Fort Erie in
Welland have by their Petition represented that

t he County of

from the rapid increase of the population of the said Village;
it has become necessary to confer upon it corporate powers; ana
prayed that it maybe incorporated accordingly; and it is desireÂ­
able to grant the prf!.yers of the said Petition.
Therefore her Majesty
enacts as follows::
From and after the passing of this Act the Inhabitants of the said
Village of Fort Erie shall be a body corporate apart :from the TownÂ­
ship of Bertie , in which the said Village is si tua t ed ;
and as such
shall have perpetual succession, and a common Seal: ï¿½ï¿½th such powÂ­
ers and pri vilages a.s are now or shall be heretofore con:fered on
INCORPORATED VILLAGES inUPPER CANADA: and the powers of such CorÂ­
poration shall be exercised b;;r, through and fn the name of the
!lUNICIPALITTY of ï¿½he VILLAGE OF FORT ERIE.

The said ViÂ·llage shall comprise and consist of the tract of Land
bounded as follows:,
Cornmencing at the Niagara River on a line with the S .,E.
angle of Lot 5 in the 1st Con;..of said Bertie Tovmship; and runÂ­
ning westerly along the southern boundary line of the said Lot,
to the S.E. angle of Loi 5 in the 2nd. Con. of the said TownÂ­
ship: thence south until the line strikes the shore of Lake Erie,
thence algng the shore of the said Lake Erie and the riverto the
place of ï¿½ eginning.
1.rnmediately after the passing of this Act, it shall be Lawful for
the Govenor of the Province to appoint a ï¿½eturning Officer for the

Village;ot which appointment the Returning Officer shall give notÂ­
ice in a newspaper,published in the said Village; or if there is
no newspaper published there, then by notice posted in at least

five; and they shall be organised as a Council in the same
manner _as in Villages incorporated ï¿½xn.der the Provisions o:f the
Upper 1.,;anada Municipal Act; and have, :ï¿½use, and exercise the
same powers and pri vilages as in the said Incorporated Villagese

From and afte'r the passing o:f this act the V il l a. ge shall Cease
to form part of the Tovvnship of Â·8ertie; and shall to all in..J;,
tents and purposes , form a seperate and independent TtunicipalÂ­
i ty; with all the privilages and rights of an Incorporated
Village in Upper Canada, but nothinp herein contained , shall
effect or be constued to effeat, any taxes imposed for the payÂ­
ment of any debts of tbe TowI1ship of Bertie aforesaid: but the
said Village of Fort Erie shall be liable to pay to the TreaÂ­
sure of the '-rovmship of 'Bertie aforesaid,
in each and every
year, until any such existing debt be fully discharged: the sarne
amount vvhich was collected
within the said Village towards
the payment of s110h debt; for the year l '356 ; and the same
shall be a. debt against the said Villageâ‚¬
Any Councillor elected to serve on the Township Courwil.ï¿½ in
the said Tow11ship of Bertie for the present year; and residing
in the above desert bed limits of the said Village; shall irnmÂ­
ediatley on the appointq".ent of the Returinï¿½' Officer : cease to
be Councilor as the case may be, to serve in the Council of the
said Tovvnship of ï¿½ertie for the remainder of the year; as in
